Official Promotional Rules

A complete copy of these rules can be obtained at the offices of Cumulus Media, Inc. (“Cumulus”), 11300 Highway 191 #2, Midland, TX 79707, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.

Cumulus will conduct the Pimp My Pad 52 Inch HDTV Giveaway (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:

1.                    No purchase is necessary.  Void where prohibited.

2.                    Listeners of KZBT and viewers of KPEJ Fox 24 are eligible to qualify. KPEJ FOX 24 qualifiers must adhere to rules posted by KPEJ FOX 24. The following rules adhere to qualifiers through KZBT.

3.                    Employees, agents, representatives, or affiliates of Cumulus, as well as businesses in which a Cumulus  employee, agent, representative, or affiliate has an ownership interest, are not eligible to participate.

3.                    An eligible business may enter the Contest only once.  Additional entries will be considered invalid.

4.                    The contest will begin on March 16, 2009 and will run through April 22, 2009 (the “Contest Period”).

5.                    To enter the Contest, be caller 9 during the morning show with Leo & Rebecca when the Pimp My Pad 52 Inch HDTV Giveaway touch tones are played.  Caller 9 will then be registered to win the Grand Prize.  Caller 9 will have opportunity to get registered more than once. His /heer name will be placed into a bucket.  To enter by mail, send an entry form to Cumulus at the address above with the following information: name,  address and phone number, name and email address.  All entries must be received by midnight on April 22, 2009. 

6.                    Grand Prize will be chosen the morning of April 22 by a representative from I-Tech west of Midland. One name will be drawn from the bucket. Winner will be announced on air and need not be present to win. In the unlikely event that no winners are found to meet the eligibility qualifications, then the prize will go un-awarded.  

7.                    One (1) grand prize will be awarded.  The grand prize package includes one 52 Inch Sony HDTV as provided by I-Tech West of Midland.  Any taxes ofor the TV will be taken care of by Grand Prize Winner.  

8.                    The winner will be notified within (30) days of the grand prize details.

9.                    All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.  The winner will be issued an IRS Form 1099 to report their prize.

10.                 All prizes are awarded “as is.”   Prizes are nontransferable and cannot be exchanged, sold, or redeemed for cash.

11.                 All entrants and winners agree that Cumulus, its subsidiaries, affiliates, members, directors, officers, employees, agents and representatives shall have no liability for any injury, misfortune, or damage to either persons or property incurred by entering, participating in, winning, or losing any contest and/or by the use or non-use of any prize received in connection with this contest.  In no event shall Cumulus be liable for loss of revenues, profits, goodwill, or other special, incidental, indirect or consequential damages of any kind.

12.                 Proper identification for the business and its authorized representative must be presented by the winner to claim the grand prize.  As a condition to receiving the prize, the authorized representative, on behalf of the winning business, must complete and sign a Winner’s Affidavit and Release, releasing the Cumulus, its subsidiaries, affiliates, members, directors, officers, employees from all liability in connection with winner’s participation in the contest, acceptance, and use or non-use of the prize, and the advertising to be aired hereunder.

13.                 All entry blanks, forms, devices, and materials gathered during the course of entry, as well as all information contained on or within (“Contest Information”), shall become the sole property of Cumulus to be used, disposed of or destroyed in its sole discretion. Cumulus may use the Contest Information to market or solicit business from contest entrants, but will not sell or distribute this information to any third parties.  Cumulus may also use Contest Information for its own internal sales and marketing purposes.  Cumulus will use commercially reasonable efforts to ensure that trade secrets or other confidential financial information provided to Cumulus is not disclosed to third parties and remains confidential.

14.                 Cumulus is not responsible for any incorrect or inaccurate information entered by website users, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Cumulus website.  The winner further agrees to allow Cumulus to use information such as, but not limited to,

15.               All entrants and winners agree to give Cumulus and its licensees, affiliates, successors, and assigns the irrevocable and unrestricted right to use, re-use, broadcast, or publish the business name, principle place of business, photo of the business’s authorized representative, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched or distorted in character or form, and authorized representative’s voice, recorded or live, for any reason that Cumulus deems necessary without compensation,  unless prohibited by law.  All winners release, discharge, and agree to hold harmless Cumulus and its subsidiaries, affiliates, members, directors, officers, employees, agents and representatives from any and all claims they may have against Cumulus in connection with the taking, production, or the use of winning business’s or authorized representative’s name, principle place of business, any photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched, or distorted in character or form and without restrictions as to any changes, transformations or alterations, and including winners’ voices, recorded or live.  All winners further acknowledge that Cumulus owns or will own exclusively any photographs of such winners used for such purposes, including the copyrights in them, regardless of the form in which they have been or may be produced and used, and all winners assign all such ownership rights to Cumulus.

16.                 By participating in the Contest, participants agree to be bound by the decisions of Cumulus personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. Cumulus will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and Cumulus’s decisions concerning such disputes shall be final.  If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond Cumulus’s control, Cumulus reserves the right to terminate this Contest, or make such other decisions regarding the administration or outcome as Cumulus deems appropriate. All decisions will be made by Cumulus are final. Cumulus may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, CUMULUS RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.

17.                 Cumulus reserves the right to limit the number of times an individual may enter a contest or drawing.

18.                 Cumulus reserves the right to require contestants to be present at drawings in order to win their prize.

19.                 A winners list may be obtained after April 22, 2009, by sending a self-addressed stamped envelope to the address first written above.
